Effective management and exploitation of sea ​​encroachment projects

Deputy Prime Minister Tran Hong Ha emphasized that developing land funds for the sea is in the national interest. Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the draft Decree regulates sea encroachment activities for socio-economic development, environmental protection, natural disaster prevention, and climate change response; Do not regulate sea encroachment activities for defense and security purposes to protect sovereignty and national interests when performing defense and security tasks on Vietnam's seas and islands.

The important contents of the Decree are: Land use planning and plans for sea areas identified for sea reclamation; Establishing, appraising and approving sea encroachment investment projects or sea encroachment items of investment projects; land allocation, land lease, allocation of identified sea areas for sea encroachment; acceptance of completed sea encroachment; determine land use fees and land rents for sea encroachment land areas; issue certificates of land use rights, ownership of houses and other assets attached to polder land; Provides for transitional handling of cases in which applications for maritime area assignment have been submitted before the effective date of this Decree.

On some issues where there are different opinions, representatives of ministries and branches have discussed and agreed to deduct sea encroachment costs from land use fees and land rents, stipulating that investors are only granted certificates of land use rights, ownership of houses and other assets attached to the land formed from sea encroachment activities after notification of acceptance results of completed sea encroachment and fulfill financial obligations regarding land.

In addition, opinions suggest that the Decree needs to review and add projects to build transport infrastructure, seaports, fishing ports, and fisheries logistics areas at sea... into the scope of regulation; develop a process diagram for implementing sea encroachment projects; Separate the process of appraisal and approval of sea encroachment investment projects and sea encroachment items using public investment capital and private capital sources; clearly stipulate the timeline for implementing investment projects using land formed from sea encroachment activities; shorten the time for acceptance and completion of sea encroachment...
